29歲的牙買加男子JR曾因在英國刺死一名15歲學生在倫敦被判處終身監禁，並被要求服刑8年後離開英國，然而刑滿之後JR提起上訴，稱自己是同性戀，返回牙買加會遭受侮辱，使得移民局無法將其驅逐出境。

環球網據英國《每日郵報》報導，2000年12月，15歲的JR以看望母親為由申請了臨時簽證到英國。雖然簽證期滿後延長期限的申請被拒絕，他仍然留在了英國。2001年9月，來英國不到一年的他就和一個14歲的同伴一起刺死了一名同學，隻因這名同學拒絕歸還欠他們的10英鎊買毒品的錢。

2002年9月，JR和他的同伴被判處終身監禁，並被要求在倫敦服刑至少8年零2個月。隨後JR的刑期被減少至6年零2個月，被要求刑滿後被驅逐出境。然而刑滿後JR提起上訴，第一次被駁回，第二次他聲稱自己是同性戀。

據悉，英國《人權法案》第三條規定，法律應當保護個人免受不人道或有辱人格的待遇。JR的母親已提供可靠證據證實他的確是同性戀。倫敦上訴法院日前已經阻止政府將JR驅逐出境，但是發出警告，JR的案件情節特殊，其他想假裝同性戀避免被驅逐出境的罪犯不會因此受益。
